PROXUS is going pink during the month of October to recognize National Breast Cancer Awareness Month (NBCAM). Since the program began in 1985, mammography rates have more than doubled for women age 50 and older, and breast cancer deaths have declined.  In other words, we're celebrating more birthdays...now that's exciting news and progress!

Justice Worker Misclassification May Become Even More Costly to Employers
Legislative efforts are underway to better enforce labor laws and strengthen requirements and penalties for setting up workers as independent contractors rather than employees. First, a proposed amendment to the Fair Labor Standards Act (FLSA) recordkeeping regulations is intended to foster openness and transparency, increase awareness among workers, and encourage greater compliance by employers. Next, the proposed Employee Misclassification Prevention Act seeks to strengthen requirements and penalties to employers for setting up workers as independent contractors rather than as employees. 

In simple terms, employee misclassification is the practice of treating a worker who is an employee under the law as something other than an employee, thus deprivin g the employee of rights and benefits to which they are entitled. As part of its ongoing efforts against misclassification The Department of Labor (DOL) has introduced new legislation under S. 3254, the "Employee Misclassification Prevention Act" (EMPA).  Its impact on employers will be significant for a number of reasons.
